What Allegheny County's Paid Parental Leave Requirement Means for Small Businesses

What Allegheny County's Paid Parental Leave Requirement Means for Small Businesses

1. Which businesses are covered?

The paid parental leave requirement applies to employers with 15 or more employees. Businesses with fewer than 15 employees are exempt from the mandate.

For many SBDC clients, this may mean:

•        Sole proprietors: Not affected
•
Many microbusinesses: Not affected
•
Businesses with 1-14 employees: Generally, exempt
•
Businesses with 15+ employees: Should begin planning

2. What benefit must be provided?

Covered employers must provide eligible employees with up to 12 weeks of paid parental leave.

3. Who is eligible?

Employees generally must:

•
Have worked for the employer for at least 6 months
•
Part-time employees must have worked at least 625 hours
•
Temporary and seasonal employees are excluded

4. What events qualify?

The leave applies to:

•
Birth of a child
•
Adoption
•
Certain permanent child placements, including qualifying foster placements
•
Stillbirth/fetal loss situations

5. How much pay is required?

Eligible employees receive their regular rate of pay during leave, subject to a maximum weekly benefit of $4,200.

6. When does it take effect?

The measure was approved by County Council on October 20, 2026 and is expected to be signed by County Executive Sara Innamorato. Employers generally have a 6-month implementation period, with some employers potentially receiving additional time tied to fiscal-year or budget cycles, up to one year after enactment.

Practical guidance for Small Businesses

For businesses with fewer than 15 employees:

"You are currently exempt from the Allegheny County paid parental leave mandate, but you should continue monitoring local employment law developments and consider whether a voluntary parental leave policy could help with employee recruitment and retention."

For businesses with 15 or more employees:

"Review employee handbooks, leave policies, payroll practices, employee counts, and benefit plans now. Budget for the potential cost of paid leave and discuss administration options with your HR advisor, benefits broker, payroll provider, and employment attorney."

The ordinance allows employers to explore private insurance approaches rather than bearing all costs directly. One provider estimate cited by the County suggested costs ranging from approximately $13-$30 per employee per month, depending on wages.

An important caveat

This is a new local requirement and legal challenges, or implementation guidance may still emerge. Businesses should watch for final regulations, employer guidance from the Allegheny County Health Department, and advice from their employment counsel before making policy changes.
